High Court asks Telangana Govt to hold transfer of Rs 7,380 Cr till clearance of PIL

HYDERABAD: A division bench of Telangana High Court consisting of Chief Justice Alok Aradhe and Justice NV Shravan Kumar hearing a Public Interest Litigation (PIL) on the Outer Ring Road (ORR) made it clear that the transfer of the concession amount of Rs 7,380 crore will be subject to the outcome of the PIL.

The PIL filed by K Mahesh Kumar pleaded the court to direct the State Government to furnish information about the initial estimated concession value of the toll operate and transfer tender of the ORR project.

The counsel for the petitioner argued that the Telangana Government awarded the tender to IRB Infrastructure Developers Ltd for a concession period of 30 years without disclosing the initial estimated concession value. He further pointed out that the GO issued on April 27,2023 allowing the transfer of the Rs 7,380 crore to the Government from HMDA coffers violated the HMDA Act,2008.

The Act stipulated that any revenue earned by disposal of land, buildings, or other properties become a part of the metropolitan development fund. On the other hand Advocate General B Shivananda Prasad sought more time and the money would be available with the government.

The Court adjourned the case to October 10, stating that the transfer should not happen till the PIL is cleared.
