IndiaMART, Abhishek Enterprises ordered to refund Rs. 11,269, compensate Rs. 6K to Hyderabad customer for inconvenience

HYDERABAD: The District Consumer Disputes Redressal directed IndiaMart and Abhishek Enterprises to jointly refund Rs. 11,269 and pay Rs. 6,000 compensation, along with Rs. 5,000 for litigation costs, for causing inconvenience and mental agony to a customer in Hyderabad.

P. Srinivas Goud (51), a resident of Nagaram, purchased a '9” Android Car Stereo for his Hyundai i20 Sports' car from Abhishek Enterprises through the IndiaMart website on December 1, 2022, by paying Rs. 11,269. Although Abhishek Enterprises assured delivery within three to five days, the product was delivered on December 14, 2022, after a delay of 14 days.

Upon opening the package, P. Srinivas Goud discovered that the screen was broken from the bottom center and had cracks throughout. He immediately contacted IndiaMart to report the damage. IndiaMart advised him to return the product to Abhishek Enterprises for a replacement.

On December 28, 2022, Srinivas Goud received the replacement product, but the mounting frame of the screen was broken, and it did not contain the cameras and parking sensors he had ordered. Abhishek Enterprises had failed to send the original product ordered and instead sent defective items.

Srinivas Goud alleged that both IndiaMart and Abhishek Enterprises failed to replace the ordered product or refund the amount paid. Consequently, he sought redressal from the commission.

Both IndiaMart and Abhishek Enterprises denied the allegations in their written responses. IndiaMart argued that they only provide technological support for suppliers to advertise their goods or services and claimed no liability for the products supplied by Abhishek Enterprises.

The court noted that Srinivas Goud provided evidence of receiving damaged products with a 14-day delay in delivery. Despite his complaints, neither IndiaMart nor Abhishek Enterprises responded adequately to replace or refund the product.

The court ruled that both IndiaMart and Abhishek Enterprises were deficient in their services to the complainant and ordered them to jointly refund the amount of Rs. 11,269 with 9 percent interest from December 1, 2022, to the date of realization. Additionally, they were directed to pay Rs. 6,000 compensation for inconvenience and mental agony, along with Rs. 5,000 towards litigation costs to Srinivas Goud within 45 days of receiving the court's order.
