HYDERABAD: The Telangana High Court Division Bench, rejecting the appeal filed by the Telangana Government, transferred the MLAs poaching case to the Central Bureau of Investigation (CBI) on Monday. However, the Special Investigation Team (SIT), set up by Telangana Government, would go to the Supreme Court to file an appeal petition.

In December 2022, two months after the poaching incident, a single-judge Bench of the High Court ordered the investigation to be transferred from the seven-member SIT to the CBI.

The judgement was passed after the Bharatiya Janata Party (BJP) and the three accused persons filed a plea for the transfer. The BJP petitions were discarded on technical grounds. However, the single-judge Bench heard pleas of the accused. After this, the Telangana Government had filed an appeal challenging the single-judge ruling.

The High Court Division Bench, headed by Chief Justice Ujjal Bhuyan, dismissed this plea and upheld the judgement passed by the single-judge Bench which transferred the case to the CBI.

What is the MLAs’ poaching case?

On October 26, three people – Ramchandra Bharti, Nandu Kumar and Simhayaji — were arrested after the Cyberabad police raided the farmhouse of a TRS MLA in Moinabad Pilot Rohith Reddy. The three men were caught in an alleged attempt to bribe four TRS (now BRS) MLAs in return to switch parties to the BJP and eventually to topple the KCR-led Government.
