MLAs’ poaching case: Telangana Govt to approach Chief Justice bench for stay

HYDERABAD: The Telangana High Court single-judge bench on Tuesday ordered that the Special Investigation Team (SIT) should approach the Chief Justice of the State High Court for hearing the appeal seeking stay on the transfer of the case to the CBI.

On Monday, the Telangana High Court upheld the order of transferring the MLAs' poaching case from the SIT to the CBI. However, the SIT filed a petition in the Court requesting for the transfer of the investigation be done after two weeks. The petition was filed as the SIT requested for time to approach the Supreme Court.

Justice B. Vijaysen Reddy of Telangana High Court asked Advocate-General of Telangana BS Prasad to take permission for seeking stay order on the poaching case.

The Judge said that there were technical objections for entertaining the petition. Usually even the Division Bench would refuse to grant such leave. The Judge also said that it applied Doctrine of Merger while dealing with the case.

The AG informed the court that he would take permission from Chief Justice Ujjal Bhuyan by 10.30 am on Wednesday for moving the stay petition.

The matter may be presented before the Chief Justice of Telangana on Wednesday.
