NEW DELHI: The Rouse Avenue Court remanded BRS MLC K Kavitha to CBI custody till April 15 in the liquor policy case.

Earlier, CBI had sought five days of custody for Kavitha. She was arrested while in judicial custody in the ED case.

Special CBI judge Kaveri Baweja passed the order after Kavitha was produced in court following her arrest by the probe agency on Thursday.

CBI counsel argued that Kavitha was one of the key conspirators in the liquor policy case and was concealing facts which are exclusively in her knowledge. The agency thus sought five days of custody.

Senior Advocate Vikram Chaudhary appearing for Kavitha argued that the arrest was illegal and unconstitutional.

Questioning the timing of her arrest he contended that the evidence based on which CBI sought her custody was from at least a year back. “ Despite the evidence, they were not willing to arrest. They only wanted to interrogate her and examine her without arrest. These evidences are much older in time. They do not have a proximate link or causal connection with the necessity to arrest. Today when they exercise the power to arrest, your lordships will look at the necessity of arrest. You didn't choose to arrest her earlier.”

He further said that there was no case made out for arresting Kavitha and that Section 41 of CrPC has been misused and abused by CBI.

”Timing is most crucial….They attempt to keep me in custody. She is a sitting member and mass popular leader of a national political party. In a few days, Telangana is to witness elections. The timing is crucial,” he said.

Chaudhary said that due process was not followed by CBI in arresting Kavitha. “This is the gross misuse of the process of law. All these evidences are not worth any evidentiary value,” he said.

The Court recently denied interim bail to Kavitha. Her regular bail plea was fixed for a hearing on April 20.
